Gardeners Belgravia Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Belgravia provides gardening and related services to residential and commercial clients. By booking or receiving any service from Gardeners Belgravia, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Client or you means the person, company or organisation requesting or receiving services from Gardeners Belgravia.

We, us or our means Gardeners Belgravia, the gardening service provider.

Services means gardening, garden maintenance, landscaping, clearance and any other services agreed between you and Gardeners Belgravia.

Site or Property means the garden, land or other premises where the Services are to be carried out.

Agreement means the contract between you and Gardeners Belgravia incorporating these Terms and Conditions and any written quotation or confirmation of booking.

2. Scope of Services

2.1 Gardeners Belgravia provides a range of gardening services which may include lawn care, hedge trimming, pruning, planting, garden tidy ups, soft landscaping, garden clearance and related works as agreed with you at the time of booking.

2.2 The specific Services to be supplied, along with the frequency of visits, estimated duration, and any special requirements, will be agreed at the time of booking or set out in a written quotation or confirmation.

2.3 Any descriptions of Services on our website, advertisements or other materials are for general guidance only. The exact scope and outcome of Services may vary depending on the condition of your garden, access and weather conditions.

2.4 We reserve the right to decline any work which we consider unsafe, inappropriate, beyond our professional competence, or contrary to law or regulation.

3. Booking Process

3.1 You may request a booking by contacting Gardeners Belgravia and providing details of the Property, the Services required, and your preferred dates and times.

3.2 We may arrange an initial visit or request photographs and other information to assess the work needed and prepare a quotation where appropriate.

3.3 A booking is only confirmed when Gardeners Belgravia has accepted your request, either verbally or in writing, and, where required, you have paid any deposit or advance payment specified by us.

3.4 For ongoing maintenance, we may agree a regular schedule of visits. Any dates and times provided are estimates and subject to change due to weather, staff availability and operational reasons. We will use reasonable efforts to inform you of any significant changes.

3.5 You are responsible for ensuring that all information you provide is accurate and complete. If information is incomplete or inaccurate, we may adjust the fee or decline to carry out the Services.

4. Access to the Property

4.1 You must ensure that we have safe and adequate access to the Property at the agreed time. This includes access through gates, communal areas, and any security systems.

4.2 Where keys, codes or access instructions are required, you must provide these in advance and ensure that any necessary permissions from landlords, neighbours or building management are in place.

4.3 If we are unable to gain access at the agreed time for reasons within your control, we may treat the visit as a late cancellation and you may be charged in accordance with the cancellation terms set out below.

4.4 You must ensure that pets, children and other persons are kept at a safe distance from areas where we are working, machinery is being used or chemicals are being applied.

5. Pricing and Quotations

5.1 Prices for Services may be based on an hourly rate, a fixed fee, or a combination of both, as specified at the time of booking or as set out in any quotation.

5.2 Any quotation provided is based on the information available at the time and is normally valid for a limited period which will be stated. We may revise a quotation if the scope of work changes, conditions at the Property are different from those described, or additional work is requested.

5.3 Unless expressly stated otherwise, quoted prices do not include disposal of green waste, materials, plants, equipment hire or specialist services. These will be charged separately where applicable.

5.4 All prices are stated in pounds sterling. Any applicable taxes will be added in accordance with UK law and clearly identified on invoices where relevant.

6. Payments and Invoicing

6.1 Payment terms will be confirmed at the time of booking. We reserve the right to request full or partial payment in advance, particularly for first-time clients, large projects or where materials must be purchased in advance.

6.2 For regular maintenance services, payment may be due on the day of service or in accordance with a periodic invoicing schedule agreed between you and Gardeners Belgravia.

6.3 Payment methods accepted will be advised by us and may include bank transfer, card payment or other commonly used UK payment methods. Cash payments may be accepted only by prior agreement.

6.4 Invoices are payable by the due date stated on the invoice. If no date is specified, payment is due within 7 days of the invoice date.

6.5 If payment is not received by the due date, we may charge interest on overdue amounts at the statutory rate permitted under UK law until full payment is received. We may also suspend or cancel future services until outstanding sums are paid.

6.6 You are responsible for any bank charges, payment processing fees or other costs incurred as a result of incorrect payment instructions or failed payments.

7. Cancellations and Rescheduling

7.1 You may cancel or reschedule a booking by providing notice to Gardeners Belgravia. The amount of notice required depends on the nature of the booking.

7.2 For standard maintenance visits and small jobs, we require at least 24 hours notice during working days to cancel or reschedule without charge.

7.3 For larger projects, multi-day works or bookings requiring special equipment or materials, we may require a longer notice period. Any such period will be confirmed at the time of booking and may be up to 7 days.

7.4 If you cancel or reschedule with less than the required notice, we may charge a cancellation fee of up to the full cost of the scheduled visit, including any non-refundable costs we have incurred.

7.5 We reserve the right to cancel or reschedule a booking due to adverse weather conditions, staff illness, equipment failure or other circumstances beyond our reasonable control. In such cases, we will endeavour to offer an alternative date or, where appropriate, a refund of any prepayments for the affected visit.

8. Client Responsibilities

8.1 You must ensure that the Property is in a condition suitable for the Services to be carried out. This includes removing significant obstructions, personal items, pet waste and hazardous materials from areas where we will be working.

8.2 You must inform us in advance of any known hazards at the Property, including uneven ground, buried services, fragile surfaces, allergies, and any restrictions on the use of certain tools or products.

8.3 If you require works near boundaries, walls, shared spaces or neighbouring properties, it is your responsibility to obtain any necessary consents and to ensure that the requested work complies with relevant covenants, planning rules and neighbour agreements.

8.4 You are responsible for ensuring that any irrigation systems, external power points or water supplies needed for the work are functional and accessible on the day of service.

9. Waste Handling and Regulatory Compliance

9.1 Gardeners Belgravia will manage green waste in accordance with applicable UK regulations and local authority requirements.

9.2 Unless specifically included in your quotation or booking confirmation, the standard Service does not include the removal of green waste or other rubbish from the Property. Where possible, we will place green waste in your garden waste bin or composting area if you request this.

9.3 If you request removal of green waste or other materials, we may charge an additional fee to cover labour, transport and disposal costs. Any such charges will be explained in advance wherever reasonably possible.

9.4 We will not remove or dispose of hazardous waste, including but not limited to asbestos, chemicals, clinical waste, oils, paints or contaminated soil. It is your responsibility to arrange safe disposal of such materials through appropriate channels.

9.5 We will comply with relevant UK and local regulations relating to the transport and disposal of waste and, where required, will use licensed waste carriers and authorised disposal facilities.

10. Materials, Plants and Products

10.1 Where we supply plants, materials or products as part of the Services, we will use reasonable care in selecting suitable items for the agreed purpose and conditions at the Property.

10.2 All plants are supplied subject to availability and seasonal variation. We cannot guarantee that specific varieties, sizes or colours will be available at all times.

10.3 We do not guarantee the long-term survival or performance of plants once they have been installed, as this is affected by factors beyond our control, including weather, pests, disease, soil conditions and your ongoing maintenance practices.

10.4 Any guarantees or warranties provided by manufacturers of products or materials used in your garden will be subject to their terms and conditions. We will not be liable for defects attributable to manufacturing faults, improper use or lack of maintenance.

11. Liability and Insurance

11.1 Gardeners Belgravia will exercise reasonable care and skill in providing the Services and will take reasonable steps to avoid damage to your property while working.

11.2 We hold appropriate insurance cover for our activities in the UK. Details of our current cover can be provided upon request.

11.3 Our liability to you for any loss or damage arising out of or in connection with the Services shall, to the extent permitted by law, be limited to the total amount paid by you for the specific Service giving rise to the claim.

11.4 We shall not be liable for any indirect or consequential losses, including loss of enjoyment, loss of profits, loss of business, loss of opportunity or loss of data.

11.5 We shall not be responsible for pre-existing defects, structural weaknesses, hidden underground services, or damage resulting from inaccurate information provided by you.

11.6 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.

12. Complaints and Defects

12.1 If you have concerns about the quality of the Services, you must notify us as soon as reasonably possible, and in any event within 7 days of the relevant visit or completion of the work.

12.2 We will investigate your complaint and, if we consider that the Services did not meet a reasonable standard, we may, at our discretion, offer to rectify the work, provide a partial refund, or agree another form of resolution.

12.3 Your failure to give us an opportunity to inspect and, where appropriate, remedy any alleged defect may affect your rights under these Terms and Conditions.

13. Force Majeure

13.1 We shall not be in breach of the Agreement or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control.

13.2 Such events may include severe weather, natural disasters, accidents, acts of government, labour disputes, interruptions to utilities, or other events that make it unsafe or impossible to carry out the Services as planned.

14. Termination

14.1 Either party may terminate an ongoing maintenance Agreement by providing written notice in accordance with any notice period agreed between the parties, or, if none is specified, by providing at least 14 days notice.

14.2 We may terminate the Agreement with immediate effect if you commit a serious breach of these Terms and Conditions, fail to pay sums due, or act in a way that is abusive, threatening or unsafe towards our staff.

14.3 Termination will not affect any rights or obligations that have already accrued as at the date of termination, including payment for Services already provided.

15. Data Protection and Privacy

15.1 We will handle any personal information you provide to us in accordance with applicable UK data protection laws.

15.2 We will use your information only for the purpose of managing your bookings, delivering Services, processing payments, and communicating with you about our services, unless we are required to disclose it by law.

16. Amendments to these Terms

16.1 Gardeners Belgravia may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that specific Agreement.

16.2 Any significant changes to these Terms and Conditions will, where reasonably possible, be communicated to regular clients or displayed clearly on our website or booking materials.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any Agreement between you and Gardeners Belgravia, are governed by and shall be construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any disputes or claims arising out of or in connection with these Terms and Conditions or their subject matter.

18. Entire Agreement

18.1 These Terms and Conditions, together with any quotation, booking confirmation or other written agreement between you and Gardeners Belgravia, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings or arrangements.

18.2 If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By proceeding with a booking or allowing work to commence, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
